License Agreement and Data Protection For Non-Commercial Research Purposes

This license agreement is a legal agreement between you and the CKDNapp team (Provider), governing your use of the CKDNapp application and web service (hereafter collectively termed “Application”) . By accepting this agreement, you acknowledge that you have read, understood, and agree to be bound by its terms and conditions. If you do not agree with any part of this agreement, you should not proceed with the use of the application.

1. Application Purpose

The application has been developed by provider to assist nephrologists in the research and treatment of chronic kidney disease (CKD) patients. It provides risk predictions for various outcomes, including progression to kidney failure, cardiovascular events, acute kidney injury, mortality, and other relevant indicators. The application is intended for research purposes only and is not a substitute for professional medical advice, diagnosis or prognosis.

2. Use and Restrictions

2.1 Limited License: Provider grants you a limited, non-exclusive, non-transferable license to use the application solely for research purposes, subject to the terms and conditions of this agreement.

2.2 User Responsibility: You are solely responsible for the accuracy and completeness of the patient data you enter into the application. Provider assumes no liability for any errors, omissions, or misuse of the application by the User.

2.3 Data Confidentiality and Protection: The Application is designed to prioritize data confidentiality and user privacy by ensuring that all patient data entered remains stored locally on your device. No backend infrastructure, cloud storage, or data transmission to the Provider is involved in the operation of the Application, and as such, the Provider does not access, store, or manage patient data in any form. The confidentiality of patient data is thus maintained through local storage, but you are responsible for implementing and maintaining appropriate security measures on your device to protect patient privacy in line with applicable data protection laws. Since all data remains local and is not stored or processed by the Provider, the Provider does not act as a Data Controller or Data Processor under the General Data Protection Regulation (GDPR).

2.4 Prohibited Use: You agree not to:

  1. Use the application for any purpose other than research or as expressly permitted by this agreement.
  2. Modify, adapt, translate, reverse engineer, decompile, or disassemble the application, in whole or in part.
  3. Use the application to infringe upon any intellectual property rights or violate any applicable laws or regulations.
  4. Share or distribute the application or any part thereof to any third party without the prior written consent of provider.

3. Intellectual Property

3.1 Ownership: The application, including all associated intellectual property rights, is owned by provider and is protected by applicable copyright, trademark, and other intellectual property laws.

4. Limitation of Liability

To the maximum extent permitted by law, in no event shall provider be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Application, even if advised of the possibility of such damages.

5. Termination

Provider may, at its sole discretion, terminate this agreement if you breach any of its terms and conditions. Upon termination, you must cease all use of the application and destroy any copies of the application in your possession.

6. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Germany. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Germany.

7. User Rights under GDPR

As the Application stores patient data locally on your device without transmission, the Provider does not manage this data and therefore does not act as a Data Controller or Data Processor under GDPR. Nevertheless, if you or other users have rights under GDPR, such as access, rectification, or deletion of data, you are solely responsible for implementing these rights on the local data stored on your device.

8. Entire Agreement

This agreement constitutes the entire agreement between you and provider concerning the subject matter hereof and supersedes all prior or contemporaneous oral or written agreements and understandings.
